Privacy Policy

IsoRay Medical, Inc. is committed to protecting your privacy.  This Privacy Policy (this "Policy") describes certain policies of IsoRay Medical, Inc. and its affiliates (“IsoRay,” “we” or “us”) with respect to its collection and use of certain information.  This Policy applies to personal information collected by us online through our website.  To the extent that we collect personal information through other means, including in person, over the phone and through facsimile communications, this Policy does not apply.

In general, you can access our website without disclosing any personal information. By using our website, you agree to this Policy and to our Terms of Use for the site.  We welcome any questions you have about this Policy, and these questions should be sent to info@isoray.com or IsoRay Medical, Inc., Attn:  Lori Woods, 350 Hills Street, Suite 106, Richland, WA 99354.

1.         Collection and Use of Personal Information.  We do not sell, rent or otherwise share your personal information with third parties for commercial purposes except as described in paragraphs 3 and 9 below.  If you provide us with personal information through our website (for example, by sending us an e-mail, requesting information about our products or applying for employment), which is not required to access our site, we retain that information for the purpose for which it is provided.  When you access certain interactive tools or services on our website, you may be asked to provide certain personally identifiable information. You may always choose not to provide the required information, but then you may not be able to participate in the portion of our website that requires the information.

If you do provide us with personally identifiable information, such as your name, postal address, e-mail address, telephone number, or other information, you agree that we may contact you through a variety of means such as postal mail, phone, or e-mail to provide you with information we believe may be of interest to you unless you opt out of this service by contacting us as indicated in paragraph 7 below.

2.         Children’s Privacy.  We do not knowingly collect information about children under the age of 13.  In the event that we become aware that we have been provided information about a child under the age of 13, we will delete that information from our records.

3.         Sharing of Personal Information.  We may share your personal information with authorized third-party agents or contractors in order to provide a requested service or transaction.  For example, if we need to ship something to you, we must share your name and address with a shipping company.  We only provide third-party agents with the minimum amount of personal information necessary to complete the requested service or transaction.  It is our intention to provide such information only to parties who we believe are trustworthy but please note that such parties may have different privacy policies.  We may also use information that we obtain to provide you with information on other products and services that we believe you might be interested in.  We may release your personal information when we believe release is appropriate to comply with the law, enforce or apply our Terms of Use and other agreements, or protect the rights, property, or safety of IsoRay, our customers, or others.  We will ask you for your consent to share your personal information with a third party for any other reason.

4.         Cookies.  IsoRay may use "cookies" to help personalize your online experience. A cookie is a small text file that is placed on your hard disk by a web page server.  Cookies contain information that can later be read by a web server in the domain that issued the cookie to you.  Cookies cannot be used to run programs or deliver viruses to your computer.

IsoRay may use cookies to store your preferences and other information on your computer in order to save you time by eliminating the need to repeatedly enter the same information and to display your personalized content on your later visits to the site.

The Help portion of the toolbar on most browsers will explain how to prevent your browser from accepting new cookies, how to have the browser alert you when you receive a new cookie, or how to disable cookies altogether.  Be aware that if you elect not to accept cookies, the site may not function properly or permit access.

5.         Non-Personal Information.  We may collect certain non-personal information about you and your use of our site whenever you visit us online.  For each visitor to the site, our web server automatically collects the following non-personally identifiable information:  your Internet service provider’s address, the referring URL, and information on the pages you access on our site.  We may also collect information such as site traffic statistics and operating system and browser type.

We also may use third-party software that tracks traffic directed to isoray.com from affiliate Web sites.  This information is aggregated and is not tied to an individual user.

This information will not personally identify you or be correlated to you individually for external purposes. We may collect, compile, store, publish, promote, report, sell, or otherwise disclose or use any and all such non-personal information, so long as such information does not personally identify you.  When we share such information with other companies, it is not traceable to any particular user, and will not be used to contact you.  If we do correlate any such information to you, it will be treated like any other personal information under this statement.

6.         Career Opportunities.  We provide an opportunity to apply for positions with us via email.  Any information you submit as part of a job application will not be used for marketing purposes.

7.         Control of Your Information.  We may provide certain opportunities to express preferences regarding our use of information that you provide, such as opportunities to decline to receive informational emails.  If you want us to remove all or certain of your information from our records, please contact us as follows: IsoRay Medical, Inc., Attn: Lori Woods, 350 Hills Street, Suite 106, Richland, WA 99354.  You must describe the information that you want removed in sufficient detail to allow us to locate that information in our records.  Please note that a request to remove information may prevent us from providing certain products or services to you.  If you want to update or correct any information that we have about you in our records, please contact us as described above in this paragraph.  You must describe the information in sufficient detail to allow us to make the appropriate update or correction.  We cannot be responsible for verifying the authenticity of requests to remove, update or correct information.  However, we reserve the right to refuse to modify information if we request proof of authority and the requesting party does not furnish appropriate proof of authority.  Please note that we can only modify information in our records and do not have the ability to modify third-party records.

8.         Security.  We are committed to protecting the security of your personal information and take precautions that we deem reasonable and appropriate to maintain the security of personal information in our possession.  However, we cannot assume responsibility for a compromise of security, and we do not maintain control over information in the possession of third-parties.

9.         Changes in our Business.  As we continue to develop our business, we might sell or buy subsidiaries or business units.  In such transactions, customer information generally is one of the transferred business assets but remains subject to the terms contained in any pre-existing Policy.  Also, in the unlikely event that we or substantially all of our assets are acquired, customer information will of course be one of the transferred assets.

10.       Reporting of Adverse Event Information.  If you contact us regarding your experience with using any of our products, we may use the information you provide in submitting reports to the U.S. Food and Drug Administration, and as otherwise required of us by law or governmental or judicial authorities. We may also use the information to contact your healthcare professional to follow up regarding an unexpected event involving the use of any of our products. You understand that applicable laws may not permit IsoRay to amend or remove personally identifiable information that is provided to IsoRay by anyone, including a healthcare professional, regarding an adverse event or reaction involving a medical device.

11.       Policy Changes.  From time to time we may use information in ways not previously described in this Policy.  Any material changes in our practices governed by this Policy will be reflected in modifications to this Policy.  If you object to any changes in this Policy, you should submit a request to remove your information from our records as described above in paragraph 7.
